American Booksellers Foundation for Free Expression won against the state of Indiana yesterday in the battle for their rights to publish “sexually explicit content” without a license. Ruling Judge Sarah Evans Baker claims that the law would leave too many loopholes for other circumstances such as R-rated movies or romance novels sold at ordinary stores or even booksellers. Interestingly, Judge Sarah Evans Baker is the same judge that overruled an anti-pornography law in 1984. ABFFE spokespeople consider this win to be a “victory for First Amendment rights of booksellers and their customers.” Meanwhile, the state has 30 days to appeal the Judge’s ruling.
